    Possession of CS Penalty Group 1 < 1 Gram in Texas
    So from what I can tell the charge for this in Texas is a state felony for possession less than one gram of a substance in penalty group 1. The substance was ecstasy.

    I was arrested about 7 months ago when this pill was found in my glove box after being stopped for one of my three tail lights being out. I finally received the letter today for an arraignment and pretrial.

    I have a completely clean record, lived in this community for 5.5 years, just finished my undergrad degree in engineering and am applying for graduate school. The question I have is more out of worry for what I can expect at this "arraignment and pretrial" as well as what I might expect for the kind of charge for my future.

    From what I can tell with a state felony you can either get charged and go to jail or fined or both, be put on probation, or deferred adjudication. For a first time offense is it highly possible to get jail time for this or is it possible for probation or even better deferred adjudication? Does background / character matter? I'm 24 now and have had the same job working for the university here since I started at 18 and wouldn't want to lose out at grad school or lose my job and waste months/years in jail.

    Controlled substances convictions can disqualify you from certain financial aid. A felony conviction can carry serious consequences. If this is your first offense, or even just your first drug offense, you may be eligible for a diversion program or "drug court"-type program which will allow you to avoid a conviction. Talk to a local criminal defense lawyer, or if you can't afford one petition the court for a court-appointed lawyer.

    I doubt you will go to jail for this, assuming it's a first offense, but the other potential consequences are significant.
