    Can a Child Support Lien be Placed on a Spouse's Home
    A couple in New Jersey is separated and in the process of a divorce. The husband has children from a prior relationship, and owes child support arrears. The wife purchased the home in which they lived during the marriage before they married, and it is titled only in her name. Could the husband's child support debt result in a lien against the wife's house?

    It is possible that the child support payee or a child support agency might examine the issue of the home, and whether the title issue is meant to prevent enforcement of child support as opposed to representing actual separate property, but that's more work than typically occurs in a child support case. It would be easier for them to try to assert a lien against his share of the marital estate through the divorce case, pursuant to NJSA Sec. 2A:17-56.23b.
