What is a Rohrs credit for college payments made for a child, under New York law?
It's a rule set forth in the case of Rohrs v Rohrs, 297 AD2d 317 [2d Dept 2002]. In simple terms, for a college aged child who is still under a child support order, the support payor receives a credit toward the basic child support obligation for the amount that parent is paying toward the child's room and board at college. The credit is not mandatory, and in considering whether to grant the credit a court will review the facts and circumstances in the particular case, and will take into account the needs of the custodial parent to maintain a household and to continue to provide certain necessaries even when the child is in college.
