I spoke to my lawyer aND he said that more than likely if I stay doing everything I have to I won't get jail time and my time will be resuspended. ..at most a month because probation is to help reabilitate and mistakes are expected. So I feel a lot better about it. I'm glad for everyone's advice but you obviously don't know what it is like to be an addict. It's an everyday struggle and I never intended to mess up things happen and yes I understand being punished is something I might deserve bUT I really am trying.
I am married to someone who has been in AA for 19 years now. I have a pretty good idea of what it's like to deal with a substance abuse problem. You're making excuses. The first step to recovery (regardless of what program you follow) is to admit that you have a problem and that it's nobody's responsibility but your own.

I never once said I didn't have a problem. I know I have a problem, it's something I deal with everyday. All I said was I've made one mistake since I've been on probation. I even said that I understand I should be punished. I also stated that I'm doing everything asked of me to help with my recovery plus extra. All I said was people and addicts especially make mistakes in life and that's what I did. I know I made a mistake and all I was saying that I thought it would be extreme to put someone in jail for sn extreme amount of time for one mistake. I didn't go back and pick up the same charge or a drug charge. I haven't peed dirty and I don't miss any of my stuff I'm suppose to do. To take everything I have worked hard to get back away would be crazy to me. It's all things I've worked hard to get back well being in recovery. If you know some one in aa then you should know relapse or slips are part of it...no it doesn't have to be for everyone but its,very common. AND honestly being a heroine addict and being sober for almost 2 years now and having only one relapse amd thatbeing alcohol I'm actually really proud of that. Yes it sucked to have to start my clean time over but my relapse doesn't define me or how hard I've worked to get where I am today. Nor does it make me a bad person. Yes I have certain rules to follow basic to most but to an addict there an everyday struggle. So breaking them deserves something but not 9 Years. Not taking me from my son for the rest of his childhood and all that is is my opinion. Doesn't mean I'm making excuses.

One of the most important jobs of the probation officer is to try to improve your odds of satisfactorily completing probation. The fact that you are a self admitted addict increases your case plan right off the top. It indicates that you have an issue that can increase your possibility of recidivating. The fact that you broke your court condition of drinking converse to the no alcohol provision on your court order indicates that you may be subbing alcohol in for your preferred substance of choice but, also was the catalyst to violating your probation.
If you're lucky, the judge could modify your order to include substance abuse treatment as a condition. If it was already included, you may have to enter a in house facility. A paper trail will demonstrate that you, not the probation department failed to maintain compliance with your conditions in order to bolster the possibility for revocation. The offense of public intoxication is not the primary issue when it comes to your revocation. The failure to be true to your word is.

Thank you for your advice..I start my drug program next week finally so I'm hoping as long as I stay giving Clean urines and participate in the program fully that they will just resuspend my sentence like my lawyer said. Since I was not in the substance abuse program before my charge I'm hoping that they will see that since I started I have been in no trouble and it's helping and I honestly hope it really does help. The First Meeting I had with them has helped in its self.
