    Chances of Emancipation in Florida
    I read the stickies and I feel like none of them truly apply to my situation. However before I take my mom to court, I'd like to know how solid my claims are. Thank you in advanced.
    I'm 17, and currently I live with my father figure (who is also my younger sisters biological dad. My biological father isn't in the picture.), whom doesn't have custody of me. I have asked her to grant him Power of Attorney, which she's refused. I was given grief to get enrolled in school, make doctors appointments, etc. There are a few reasons why I won't move in with her, listed below. *She's Unstable - She's in and out of jail, moving every 6 months to a year. My Father Figure on the other hand, owns his own house, which he's had from 1999, and has his own business. The court granted him custody of my sister last year.
    *She's thrown me out- The first time she threw my out, I was 9 years old and her boyfriend at the time wanted me gone. She dropped me off at my Aunt doorstep and gave her POA. However, my uncle, by marriage, had molested me. Not too keen to move in with her.
    *She's overall a bad parent- In 2011, her boyfriend at the time molested me on the couch. I screamed for her, told her what happened, and she didn't throw him out. I continued to live with my abuser, with her knowledge of events. There was a trial because he, a few weeks later, drugged her, and tried to get nudes from my friend, whom was staying the night. He was convicted. In 2012, she abandoned my sister and I to my grandmother, and hasn't looked back.
    I am practically 17 (Birthday is 02-21-00), I have a much better life with my Father Figure, I have a job and can support myself, and I just want away from all the legal and medical mess that my mother has created for me. What are my chances of getting emancipated?

    You didn't read enough.

    In Florida, the parent/s must file the emancipation petition - not the minor.

    Or to put it another way, if Mom is not willing to sign the emancipation petition, you're never going to even get to court.
