    What Evidence Will Support a Burglary Conviction
    A man is charged with a burglary in Florida. The prosecution is based upon the statement of his girlfriend, and there is no other evidence that he was in the burgled home. If she does not appear to testify at his trial, will the charge be dismissed?

    It will be up to the prosecutor. The prosecutor might, instead, seek to have the girlfriend treated as a material witness, picked up and required to post a bond or be held in jail until a new trial date, then brought to court to testify. The man should discuss his charge with his criminal defense lawyer.
