Credit Card Fraud at Work
An employee was caught committing credit card fraud at work. She was using credit card information to add or modify tips to purchases. Her manager has asked that she provide him with the pictures that she took of the credit cards, so that they know who all of the victims were and can undo all of the unauthorized charges. Will she get any benefit from cooperating, or be able to avoid being criminally charged?
Re: Credit Card Fraud at Work
If the matter is turned over to the police, the issue of whether or not she cooperated with her employer is not likely to affect the decision to charge her. It is possible that a prosecutor would take into account the fact that the defendant has provided the information necessary to give refunds to her primary victims, or has paid full restitution, and the same factors may be considered by a judge at sentencing. But if she's looking at criminal charges, she should be consulting a criminal defense lawyer.
