An attorney-in-fact in Florida is not abiding by the restrictions placed on his actions by a durable power of attorney, and is misusing the grantor's assets. The grantor is elderly and is not in a good position to object. Is the holder of the power of attorney committing a crime?

If they are in fact committing financial misconduct, then the odds are that their conduct could support a criminal charge.
A concerned individual may contact adult protective services. If they are sufficiently involved in the matter that they want to take on the responsibility, they can consider petitioning for conservatorship.
