I Need Help
See, my father lives in Florida and my mother lives in New York. I'm tossed around back and forth. My dad is a drug addict and my mother is an alcoholic. They are getting divorced soon, and my mother already has a finance` and a kid. I rarely speak to my father. And my mother lives in a basement with her family. I'm basically forced to live with my grandparents, my aunt and my uncle. This is a 3 bedroom apartment, so either way I go, I either sleep on a couch or a floor. I want to get emanicapted, but I have a year. I want to go live with my cousin, who has her own 2 bedroom appartment and lives with only her daughter. She's offered to let me stay there, but I'm registered in school in New York, and my mother won't let me just leave like that. I'm wondering if there's anything I can do right now or sometime soon, to help me get out of here. My parents and the family I live with do nothing but fight. And when I try and talk to them about it, they deny. So I'm lost right now.

Whoever has custody has legal authority over you. You cannot move without parental consent. There appears to be no emancepation laws in New York

I was trying to figure out what that ment. No emancipation laws in New York? I don't get it. And they both have custody, but nethier of them care. But I'm just worried about my school asking questions. I need to transfer them to a Florida school. and thank you for answering my questions.

Long as you have parental consent you can live anyhwere but they (your parents) will still be legally responsible for you. No Laws mean just that no Laws! Not all States have emancepation laws

But what I'm not getting is the fact that since there is no law, I can file for it at 15? And would they(the law inforcment) take a 15 year old runaway seriuosly, or just put it to the side. As they do anthoer things

If you runaway your chances of emancepation are slim and none!

Oh. Because my parents emotionally abuse me. They tell me everything is my fault. When in reality, thier unhappy with their lives. I am my families punching bag basically. I've had child services come to both my house in New York and in Florida, since I was about 7. I've had them tell me they (my parents) are emotionally abusing me. But, I denied everything for the fear of my parents hating me. But now, I could care less. I'm just worried about how I'm feeling. And as far as the No Law thing, could this mean I could go to them right now, and see what they said. Or it's like they don't allow it, what so ever.

Go to who? Your not going to be emancepated. If you can get parental consent yuo can live elsewhere. If you have abuse issues contact CPS so that both you and your parents can get help! If CPS feels your homelife a danger they can remove you! Running away is not an option! Work within the system its slow but its your best bet.

Go to the court system with a petion or whatever you need. I already have a job, been with it for about 4-5 months now. I have a place to stay other than with family. I just don't know what to do. And as far as the CPS, yeah they would help me, but I would be moved into a foster home. And that's not what I want.
