Bench Warrant and Fraud Charges Over a Loan
My question involves criminal law for the state of Massachusetts.

Yesterday, I got a call from some national filing Place stating that a bench warrant was going to be issued in regards to fraud. The young lady gives me a number and I call them to ask them what was going on because this was the first time that I'm hearing about this issue. She gives me a discovery loans company but she refused to give me the name and number, refused to give me any information and told me that they were going to forward over to Bristol County for a warrant. When I told the young lady that I knew nothing of this and I've never been contact about it she didn't care and I told her well I'll try to get a lawyer. Today I get a call from Bristol County saying that this company sent it to the wrong department need to be Criminal and that they're going to issue a warrant within 24 to 48 hours and was wondering if I was going to turn myself in. I live in California and been employed for the last four years, I work on a Federal Institution that doesn't allow felonies and I just went through a background check which came out clear. I don't know when this event happened or how much it is for I don't know anything and they won't give me any information. How should I go by doing this? The last time I was in Massachusetts was 10 years ago for 4 months because so I'm really confused about this. Supposely there's two counts of Fraud and I don't even know for what. Any advice would be great thank you.

I believe what you are stating is that a collection firm of some sort called you and told you that if you don't give them money, you are going to be arrested and prosecuted for fraud; but if you pay them money the charges will go away.

If that inference is correct, you are being scammed.

Perhaps you can clarify what you mean by "Today I get a call from Bristol County". No court clerk is going to make statements like that over a case that hasn't even been filed properly.

It seems that someone is trying to scam you out of money.

Look at the following web page:

    https://callsreported.com/8886882977...eported?page=3

Search for the words "Bristol County" on that page, and you'll see that some guy named Tom was called about money owed to Bristol County. When Tom mentioned that Tom was a cop and started asking some questions, the caller hung up.

The collection firm that called me first was National filing and claim services. A woman called and left me a voicemail stating that she was from the Bristol County Superior Court. She was informing me that the company who is filing this paperwork (Discover cash funding) has fax over paperwork to the wrong. She stated that it should of been faxed over to criminal and that once the paperwork is filed back to the criminal dept a warrant will be issued within 24-48 hrs. She was giving me a courtesy call.

This is a scam. Ignore it. I've received similar calls in the past. As you've not even received a collection notice from the company they are naming it's likely a scam and you're falling for it hook line and sinker.

You should report this company's conduct to the FTC, the CFPB, and your state attorney general's office.
