    Harassment by a Loan Servicer
    My question involves a consumer law issue in the State of: Illinois

    Can you sue a lender who has been calling you even though your payments are current?

    I had a loan acquired by a servicer who constantly called me between the 1st and the 15th of the month until I made my payment. I had always paid by the 15th but when this servicer took over the calls never stopped in between the 1st and the 15th of the month. This went on for about 2 years starting in 2014.

    Is the payment due on the first of each month but isn't "late" until the 16th?

    If the answer to free9man's question is yes, then in reality your payment is in fact late as of the second of the month even if they do not charge a late fee until the 16th.

    Continuing with the probability the payment is in fact late starting the 2nd of each month, you may want to check your credit report history as it is likely being reported as delinquent every month. Paying late by two weeks every month for years could cause a big drop in your credit score.
