Seeking SSDI After a Lump Sum Workers Compensation Settlement
If you receive a lump sum workers compensation settlement that includes future benefits, then apply for SSDI, how does the settlement affect your SSDI benefits? Does it make a difference that the worker was able to return to work for several years after the settlement?
Re: Seeking SSDI After a Lump Sum Workers Compensation Settlement
The Social Security Administration (SSA) applies an offset to workers compensation benefits, so if this were merely a situation in which somebody settled a workers comp case and sought SSDI benefits the worker would normally send details of the workers comp settlement to the SSA for its evaluation in relation to benefits.
However, with a return to work the prior workers comp settlement should have no effect on SSDI benefits following that return to work.
