    Embezzlement over $1000 under $20,000 in Michigan
    hi ive got to go to court next week for a felony imbezzlement under $20,000.
    i worked at a speedway gas station and stole around $3,000.00
    I've done everything i was suppose to and have admitted to doing it. ive been convicted of a misdemeanor possesion of marijuana when i was 17 and released off probation when i was 18 and this has been my only charge. my question is,
    Will i go to jail for this even though ive been cooperative and admitted guilt.
    i am on crutches right now w/ 4 screws and a plate in my ankle and i have two kids in which i watch while my wife is at work because we cant afford daycare and dont qualify for help from the state.if i go to jail we will have a huge problem with finding someone to care for our kids while im in. will they send me to jail for my first felony offence or will i probably get fines,restitution,and/or probation?
    i have a court appointed attorney. im doin everything i can to avoid jail and cannot sleep with this worry on my mind.if u could shoot me a reply and tell me what will probably happen id greatly appreciate it.this is a very embarressing charge and im really not a thief. i was just put in a bad situation and was almost dead broke.

    Just to warn you: saying "i worked at a speedway gas station and stole around $3,000.00" and following it up with "im really not a thief" is going to net you all kinds of grief.

    Your lawyer is the best person to ask about your probable sentence. I've seen people get probation with worse facts than this.

    i know that but i dont even know who my court appointed is yet.
    they have yet to let me know that and i go to pre court tuesday and a second time on thursday for sentencing i believe.i just cant sleep not havin some kid of idea of what will happen. ive admitted in front of the investigators at the police department i did it.waited 5 months and last week i got my letter in the mail sayin they put a warrant out for me and that i had to go to the police department to get pictured and fingerprinted.after that i went to the court house and met the magestrate and they let me go on pr bond and this is where im at now.i know its not smart goin into court and sayin i stole but im not a thief.im not stupid, a judge would laugh at me if i said that.in life people mess up and i dont know if youve ever been dead broke,with bills pylin up wonderin where your gonna sleep when it gets dark but i was in the gutter.sad to say but i truly was.i honestly stole the money to beable to have a warm bed that month.im not gonna go tellin a judge that because theres no reason for what i did and no way to justify it:confused: i was just wanting to know.if in the situation i'm in, not being able to walk and being the primary care provider for our kids if they would cut me a break and give me restitution/fines/probation or if id probably get jail time even though im in this situation.ive been told by some lady that studied law that they usually dont lock you up for your first felony embezzlement,they usually load you with fines and charges instead.is this true?
    i know i would be best off askin my attorney but i dont even know who he/she is. any help once again would be appreciated.

    Call the court where your case is being held. They should know who he/she is. They have your attorney's name and phone #.

    man its hard to get a str8 answer in here.i know i need to talk to my lawyor.
    but this is suppose to be imformation how come its so hard to get a str8 answer.is our government ****ed up to a point where nobody knows anything anymore? :wallbang:

    Can a person be put in jail for a first offence felony embezzlement?
    (amount embezzled was 3,000)

    can a person that is the main care taker be sentenced.if im sentenced to jail what will the state do to help us with having our kids watched? (probably nothing cuz they dont ever wanna help any other time)

    will they put me in jail with just getting out of surgury and requiring so much medical attn.

    if locked up will i receive help for my medical condition?
    i wouldnt feel safe in population with a broken foot
    Question 5
    instead of being locked up whats the chances of me getting away with just restitution/fines?

    I am not a lawyer.

    question 1: You have asked if a person CAN be put in jail. If jail time is a possible sentence for your crime, then of course jail time is possible!

    question 2: I am not a lawyer but yes, I do know of situations where primary caretakers have received jail/prison sentences. If there is nobody available to take care of your children then you might be able to arrange for their care or foster parents might be provided. This is DEFINITELY a question for your lawyer.

    question 3: If your punishment includes jail time, I doubt that your medical condition will excuse you from your sentence. Your lawyer would be a much better person to ask.

    question 4: As far as I know, jails/prisons have medical facilities available. You might want to double check with your lawyer.

    question 5: There are thousands of variables that affect sentencing. Talk to your lawyer and share your concerns with him! I've read many cases of embezzlers receiving a punishment of only fines/community service, but it depends on the circumstances of your case. I've also read (fewer) cases of first-time embezzlers receiving jail time.

    im so mad, i called the court today and my pre trial is tomorrow and they dont have a court appointed on file for me.i talked to an investigator in pre trial and he said in the beginning of the week he'd apoint me one and i somehow still dont know who he/she is. i can honestly say i think ingham county michigan's court employees are horrible.everytime i call he/she is away from their desk..its like...us tax payers pay for these people and they dont help with s**t.i was worrying about my charges and now im worried bout the fack that ill even have a lawyor.im so pissed off right now. Has this ever happen to anyone? what will happen?

    What does that even mean?

    You either filled out a petition for a court-appointed lawyer and turned it into the court or you didn't. If you didn't, stop by the court and file a petition.

    ok so i just got off the phone with the court for the hundredth time and they told me "if it is a court appointed, you usually dont speak to him/her until your court date and if you get here and dont have one appointed to you we have them running around here all day, we will appoint one to you when you get here" so i guess one last night of no sleep and another day of worrying.:confused: if you are reading this please take it from me...never steal, even if your dead broke and living on the streets. this feeling i have right now is almost worst than losing a loved one and its my first offence.i cant sleep,i think about it all day and night,and its just not worth it.I dont know about where u live but where i am it seems the court has a bunch of dumb azzes working and they dont give two sh*ts about you and what u need.and not only that but i dont think i'll ever beable to get this off my record.i have to replan my whole life because of this because what i had planned definitly wont happen with a felony,much less an embezzlement felony.:wallbang: anyways
