Your son's a grown-up and is responsible for his actions. But you're letting him live in your house with a woman who is below the drinking age, know she's drinking, and apparently can set and enforce certain house rules, so I can't say that there's no possibility that somebody injured by her would contend that you share liability. There are also municipalities in California which have social host liability ordinances, so you would have to check your local ordinances to see what they have to say about your situation.

Well today I made it quite clear that there is to be NO drinking on her part, and if she does will be evicted.
My son wants to stay here so will do whatever he needs to do to make that happen.
Now I can evict her on those premises, correct? That if she drinks, and is underage, I do have the right to do this???

If she's a month-to-month tenant, you would normally be able to end her tenancy with a month's notice. This guide will help explain the process.

So here is the latest- last night she came to me and asked for a second chance- and of course I had my wall up,and said nothing either way- and sure enough- today- her and my son and their friends are out in the alley smoking pot and drinking-so I walk out there and asked her "so is this what you meant by a second chance?" and she would'nt even look at me-
so can I verbally give them notice followed by a written 3 day notice?
I actually found some of their pot laying in a container on the floor, so I picked it up and put it away,and have witnesses to the behaviour.

I need to clarify the information that I provided in the previous post.
California Code of Civil Procedure provides:

1161.
4. Any tenant, subtenant, or executor or administrator of his or her estate heretofore qualified and now acting, or hereafter to be qualified and act, assigning or subletting or committing waste upon the demised premises, contrary to the conditions or covenants of his or her lease, or maintaining, committing, or permitting the maintenance or commission of a nuisance upon the demised premises or using the premises for an unlawful purpose, thereby terminates the lease, and the landlord, or his or her successor in estate, shall upon service of three days' notice to quit upon the person or persons in possession, be entitled to restitution of possession of the demised premises under this chapter. For purposes of this subdivision, a person who illegally sells a controlled substance upon the premises or uses the premises to further that purpose, shall be deemed to have committed a nuisance upon the premises.
Are they selling?
If not, go with the 30 day written notice.
