Changes to Vacation Time Rules Without Notice
If a business is sold, can the new owner change vacation time policies without notice. For example, if senior employees earned a greater number of vacation days per year than junior employees, can the employer either eliminate that policy, or tell senior employees that their start date is being reset to the date of acquisition of the business, in order to reduce their future vacation time?
Re: Changes to Vacation Time Rules Without Notice
Employers are normally able to make prospective changes to vacation time policy, so they can change the rules for acquiring additional vacation time going forward. That would include the ability to reduce vacation time or to eliminate prior rules that favored senior employees.
If the rule change has a disproportionate impact on workers over the age of forty, there is the possibility of trying to build an age discrimination case; if there's any such possibility, discuss the details of the situation with a plaintiff-side employment lawyer.
