    Is it Harassment for an Officer to Repeatedly Charge a Suspended Driver
    My question involves a driver's license issued by the State of: Indiana
    My fiance is being harassed by an Officer in our small town over personal issue. The officer, his wife, my fiance, and I were all good friends. My fiance's license have always been suspended, but we were all friends. The officer allowed him to drive their personal vehicle, pull their boat, drive to and from their home. My fiance and I had some problems last summer and split up, during the break up he and the officers wife cheated together. The officer has now waited for him on 3 separate occasions on his route home and pulled him over and took him to jail. My fiance changed vehicles with tinted windows and was driving in a different area, but the officer found out from a mutual friend where his job was located at and was out of his normal jurisdiction. He was pulled over in a church parking lot waiting on him to drive by, but you cannot see in the windows because the tint is so dark. Well, my fiance seen him pull out but there was several cars in between. He then pulled into gas station got out of the truck placed keys under the seat and went inside. The police officer did not turn on his lights but came into the gas station and asked him to come out. He arrested him once again. Is this not harassment? I have a CD where the officer took his wife's phone and had another officer download the messages between my fiance and his wife, I have all of the officers text messages with him telling me he was going to take My fiance down. At the time we were separated and of course I was mad, but never looked at the messages because I didn't want to see what happened. I believe I have strong grounds for harassment. Also, if he didn't see him step out of the drivers seat or identify him driving because of the tinted windows how can he charge him?

    You don't know the officer didn't see him getting out of the driver's seat.

    Why is your fiance's license suspended and why has he not taken steps to get that resolved?

    It does sound like it is harassment although an argument could be made that it is just good police work. Your fiance is, after all, breaking the law every time he drives. Has your fiance made a personnel complaint with the department?

    Your fiance can solve this easily: Stop breaking the law by driving! Easy!

    Arguably, if the officer sees your fiance and knows he is driving and FAILS to take action, he is being derelict in his duty.

    But, your fiance is free to complain to the agency that he keeps getting arrested for crimes he commits in the officer's presence ... huh ... that doesn't sound like such a good idea.

    If I was you I'd be more concerned about why my fiance is driving with a suspended license. He is the problem, not the police.

    If he stops breaking the law then the "harassment" will stop too.

    The problem is that your fiancé violates the law each and every time he drives while his license is suspended. So the police may indeed arrest him and charge him with driving while suspended each and every time he does it. It may feel like harassment to you and your fiancé, but what the officer is doing is not illegal. Indeed, what was improper was the officer allowing your fiancé to drive the officer’s personal car when he knew your fiancé had a suspended license. But of course that improper behavior didn’t bother you guys because it benefited you and you were all buddies at the time. Your fiancé can resolve this “harassment” quite easily by doing one of two things: get a valid license or stop driving. But if he chooses to drive while suspended, he really can’t complain when he gets stopped and arrested for violating the law.

    Hanging around your friends driveway waiting to see if he's going to drive again isn't very sporting (the term we use is shooting fish in a barrel), but the police are not required to be so. Hanging around where criminals are likely to commit crimes is what we call "good police work."

    I always enjoyed people saying, "It's not fair!" when we hang around such "fishing holes" and wait for people to commit crimes.

    Now, there are some ethical issues with allowing a potential drunk driver to get behind a wheel as they may become a DEADLY driver. But, an unlicensed driver? Not quite the same level of risk.

    Maybe your beloved should quit breaking the law. For crying out loud, he can be arrested every single time he does it. If your beloved doesn't arrested or charged, he shouldn't do it.

    I never said what he was doing was the correct or legal way, but using your Professional Position as a law officer to get "even" because your wife is lose with herself isn't a Good officer.

    We have a meeting set up with the department. Also, he never had his license. We are in the process of working with an Attorney to get this all cleared up, but getting pulled over is hurting the progress

    Ha, so it is professional to overstep your position as a law officer because you are mad cause your wife is a cheater? The police officer allowed him to drive his personal vehicle before, matter of fact, asked him to drive it. That is a good police officer? Oh and did I mention the fact that his wife drives drunk in his presence as well?

    Correct, we have an issue in our small town with the Meth Epidemic...why not chase down real criminals.

    and if the officer wants to be recognized as being a good officer maybe he shouldn't use his personal issues during his professional issues. There are "real criminals" out there...thanks
