    Trial Date is Scheduled Before the Mediation Date
    My question involves collection proceedings in the State of: FLORIDA

    Hi guys, I got a question, I have an ongoing Lawsuit, Zwicker and Associates is suing me on behalf of Discover Card. Sometime in July I received a letter from the Court, the trial was set for Monday October 31st ( this coming Monday). Then mediation was requested, I missed the appointment (notification went to the wrong address and I was out of the Country). A DEFAULT was entered against me. When I found out, I collected all the information needed, went to the Courthouse and filed a Motion to set aside Default. I received two documents a few days ago, first, the Order Setting Aside Default ( Plaintiff hates me now!!!) and a new order for mediation scheduled for November 22nd, 2016. My question is: Do I still need to go to the Courthouse this coming Monday for the trial, as it was originally scheduled 10/31, or it is going to be rescheduled after the mediation date??? Thanks guys.

    Odds are the trial date has been adjourned, but nobody here can make any promises. If you can do so before having to head to the courthouse for your hearing, check with the court first thing in the morning.

    Tonight you can try the court website and check the docket for your case.

    If the docket doesn't show that the trial has been cancelled then I agree that you call the court first thing in the AM. If somebody on the phone tells you it's been cancelled and you still don't see it on the website's docket I suggest you get yourself down to the court house and get something in writing.

    You can often find a direct phone number for a judge's courtroom on the court website, then directly communicate with the judge's recording secretary before the session of court begins for the day, and ask if the case is still on the docket. Once the court staff moves into the courtroom for a session of court, it may not be possible to reach somebody in the judge's chambers who can provide information about the day's docket.
