Custody or Visitation for a Father Who Neglected the Child for a Year
My question involves child abuse or neglect in the State of: Massachusetts
My son's father has been in and out of his life since 6 months old. It has been an on going custody battle. He has gotten arrested with him before. He has a long history of drug charges and assualts violent crimes. Last August 2015 he was arrested with our son because of outstanding warrants for a crime that was violent. His visitation was suspended. he got out in December and didn't go to court until March where the judge kept his visitation suspended and under advisement. A week later I got the judges order to set up my son's part for supervised visits every other Saturday for an hour. His father failed to set up his part. Meanwhile he moved 3 hours away to maine. We had another court date set up for June which he did not show up for and got his visitation suspended again. Also in all of this child support has never really come in my son is 5 now and he owes a little over 15,000 dollars. He recently moved back to mass and I got my first payment from him of 54$ when it's supposed to be 99$ a week that order was set since 2013 after him not paying a lower amount. I am worried he is going to try jumping back in my son's life. Like I said he has a violent arrest record and drug record he also hasn't seen him in over a year and came in and out of his life before. I also have had to get immediately return child to mother orders sent out because he'd take off and not bring him back for weeks but they said it wasn't parental kid napping. I'm confused on what to do here I fear for my son's safety. I fear he could take off with him again and the next time could be the last time I see my son. Even with supervised visits I'm terrified he will play his normal game get visitation back and bam take off with my son. Not only that but he has never had a stable living situation. I would like to file a motion to remove his rights as the father or petition the court to do so because whenever he is in our lives he makes us miserable by taking off with him or calling dcf making false accusations (I am a daycare teacher) he does it to try and hurt me cuz I could loose my job he did it before I didn't loose my job but he thought I had and his argument in court was he wanted custody so I'd have to pay him. He is scary and I never know what to expect any expert advise on what to do would be great. I'm a single mom can't get a lawyer and can't get a probono lawyer either.

Expect the court to grant him supervised visits.

You are not going to get dad's rights terminated. The state wants two parents on the hook to support a child, even if one of them is very bad about doing so. However, I think that you are borrowing trouble at this point. His visitation is currently suspended and he would have to go back to court to get it reinstated. The last time that he did that he received supervised visitation and never followed through. What really are the odds of him going through that exercise again?

They are not going to terminate his rights because he is an absentee father. Right now he has no visitation right? So let him file again. Last time, as stated, he didn't show up. He probably won't show up again.
He actually stated in court that he wanted custody so you would have to pay him? Really? To the judge he said that? I wouldn't think that would go over very well with the judge.
You are probably never seeing child support either...just fyi.
You have custody. He doesn't have visitation. Even if he gets unsupervised visitation back he can't just take off with the kid and not bring him back when his visitation ends. He could take him but he'll get in trouble. I don't know why he didn't get in trouble before if he was violating the custody order.
I would just not worry about it. It doesn't sound like he really even cares if he hasn't done what he's supposed to in order to see his child.
