    My experience so far with misdemeaner charges pending against me in California
    I hope if I tell my story and ask more questions that I can help others. If you did steal/shoplift do not let your emotions dicktake your decisions. I made the mistake of choosing the first lawer I saw, because he scared me and my wife into believing that I would go to jail and have big fines with out him. The lawer asked me to do research to prove the price of the item I stole was lower than Kmart claims. I spent alot of time researching then, I turned the info into him. Now- I get a phone call from him/my attorney. He ripped me apart for getting the wrong info, wasteing his time, also says I am trying to sudgest I am trying to present dishonest information to the court and using him !!! He said do not call him back !!!! Can this guy drop me before my next court date next week ???? This guy also is trying to take credit for the court, the court, lowering my charge from a felony to misdemeanor so far! But I have no choice to keep this guy as of $2500 have already been spent on him, all the money is gone!!!!

    I would also like to add that I have had to contact my attorney each time to get the information on my case. Then, he only had time for a phone conversation and told me to go to work to help my case !!! He also informed me of a plea deal---- 10 days jail, 3 years probation, a search of my home for stolen propery and fines :eek: All this for someone with a clean criminal record , first time offense ..... This no deal I said I would like to state my case to the judge......

    I sure hope this guy gave you a big fat smooch!!! 'Cause it not's really a good screw unless you get kissed real good......

    Seriously, if this guy has appeared already with you in court then you may have grounds for filing an unscrupulous behavior complaint with your local bar association. Shoot, you may have grounds anyway! He made you do some of the 'legwork'...that's pretty much total bullshit. What exactly are you paying him for? That's the type of work that he is to be doing. I'd file a complaint with the bar association for his (possible) unscrupulous activity anyway.

    You are most definitely not getting your money's worth and will most likely suffer for it before it is all said and done.

    After thinking about my situation some more I came to some of the same conclusions. I am doing a job / leg work that I thought a big time attorney, that he wants to act like, would have a team of workers to help him win a case.:confused: But I have to tread lightly here. Yes, he showed up for my arraingment and I have another court date, preliminary hearing, but I was told I do not have to show up. :confused: I want to show up, if the deal is still the same then, I want to go before a judge and state my problem with my attorney and jail time > I hope the judge will give me community service, so I can help others and not just sit in a jail cell for 10 days wasting the states time and money. I believe in punishment for a crime. I am learning my lesson here, but 10 days in a overcrowded, unstaffed jail and 3 years, thats 3 years probation for 1 offense , NO DEAL...

    Your Attorney asked you not to call him has he fired himself!? If so great. do you have a contract can you fire him? You might request a new Attorney when in court. You might even contact DA and ask him how you can accept however and bypass your Attorney this guy is taking you for a ride and like soups said my cost you more than you would have had. Another thuoght is consultation (free) with another Attorney to see what options are as well take with you any contract you have with current Lawyer

    Lawyers get paid to perform legal work. Most clients prefer not to pay a lawyer's hourly rate for work they can do themselves for free or, if they're feeling like paying for the work, performed for a lot less by a private investigator.

    Aaron can Fish fire his Attorney or take other actions since he feels his Attorney is taking his money but not doing as he wishes?

    Firing a lawyer during a criminal prosecution can be a bit tricky unless there is another lawyer ready to substitute in as counsel, as sometimes defendants fire their lawyers in an effort to manipulate the process. Also, judges are sometimes not very sympathetic to a lawyer who, on the eve of trial, tries to get out of a case because the client owes him money. But subject to any such restriction by the court, a client can fire a lawyer at any time.

    What if client wants to fire Attorney and accept plea deal thsu ending case not extending it?

    Let me correct my post some. My attorney said "Not to waste my time with this one matter anymore unless you bring me exactly what I want". "If you can not find want I want then I assume it does not exist" What is wrong with this picture:confused: I have learned alot how the justice system works and I will show up to me hearing . I just hope he/ my attorney will continue working for me, another thing he ask me why I would have a problem with 10 days in jail ? I told him why and asked to see about diversion. He said o yes there is diversion to keep me out of jail. So I am feeling real jerked around with this guy !!! Am I right ?
