Absence from the U.S. Without a Re-Entry Permit
A married couple, U.S. permanent residents immigrating from India, were visiting India when the husband fell seriously ill. They spent eight months in India for medical treatment, with no re-entry permit. They weren't thinking about immigration issues during the time, and stayed in India due to both the high cost of medical travel and the comparative cost of medical treatment. Now that they want to return to the U.S. will they have a problem?

With an absence of less than a year, they should be prepared to document the reason for the absence with an immigration officer when they seek reentry into the United States, along with evidence of their continued residency in the United States. They may not need to present the evidence, but it's sensible to be prepared.
