Child's Preference and Custody for Unmarried Parents
Two parents in Pennsylvania were never married and came to a mutual agreement for custody. They do not have a custody order. Their child presently alternates weeks with each parent. The child has decided that he now wants to live with is father full-time. Can a fifteen-year-old choose where he lives?
Re: Child's Preference and Custody for Unmarried Parents
The child does not have the right to dictate where he lives. The child is old enough that, if presented to the court, the court can consider the child's preference when making a custody determination -- but for now he does what his parents tell him to do, and it would be up to the father to bring a custody case. The mother may benefit from learning more about custody and adolescence.
