Stolen Credit Cards from years ago
Hi,
State is NJ.
I am posting for my best friend. She has some concerns and I told her I would look into it for her.
Several years ago she worked at a supermarket and did some things she regrets now. I am assuming it was 5...not quite 6 years...a good 5 though.
She knew someone (an employee) had a stolen credit card...the employee used the credit card on her register (she was the one who rang the order up). She knew it was stolen and let him make a purchase on it (just a few dollars she said). The employee then went crazy in the mall and made a bunch of purchaces and a detective came into her work back then and was asking her questions if she knew who the person was etc. Now, about 5 years later, she hasent heard anything. I told her that she wasn't the one who made all the purchases or stole anything and it's been a while and there is nothing to worry about.
Can she get in trouble for this?
2 - She had a credit card that was lost and one of the employees asked if they could have it..Her being her stupid self gave the employee (this is a different person) the credit card. Again, she didnt go out and buy anything but knew that she gave someone a credit card that he was going to use to purchase items with. Again, 5 years or so later, nothing has happened.....so I keep telling her it's not a problem for you - you weren't the one whole went out and bought all these items.
3 - She worked with another employee who wrote bad checks (her account..not stolen or fake checks - maybe closed account, not sure) all the time to the store. She would cash the checks for her, knowing they were bad. Again, about 5 years ago..i am assuming. Anyway, her job found out and she did not get fired and the lady never got charged with anything but I believe is still paying back monthly payments for a total of over several thousand dollars. Not all those checks the employee wrote were just to my friend. From what she tells me, law never got involved with her employee.
That's it! So I tell her that she didn't go out and purchase anything..so how could that make her the bad gal? And, it's been several years and she has no clue how much those people bought. Maybe a few hundred dollars each? Don't know.

Also, doesn't statute of limitations play into this?

In all three cases she committed crimes which could have been prosecuted.
The odds of prosecution for this type of offense approach zero after five years, whatever the statute of limitations. But it is likely that New Jersey would in fact apply a five year statute of limitations. (See NJS § 2C:1-6)

Thank you for the response. Let's say it is 4 years right now...she thinks it's five. Can she still get in trouble? Who knows if there is proof etc. of her giving anyone the cards. What if the other people got caught...it would be there word against hers? How would that work?

Last questions...you say it is "likely" they put a five year statute on? Do they definitely do that or no?

The limitations period can vary based on the charge.
I am not going to guess as to what evidence exists. If nothing else, she confessed to you.

So should I tell her she is safe DEFINITELY after 5 years? Should I tell her the odds have gone down if its say 4 years? Or can the limitations go beyond 5 years?

As you were previously told, the limitations period can vary based on the charge. You can research the statutes to determine whether she could conceivably be charged with an offense with a longer limitations period, assuming it has in fact been five years.

Ok, she has one more question...sorry to keep bothering you.
Based on what I have told you here (which is all she told me) - and providing that everything is accurate - The five year limitation would be the max? I have a hard time understanding about the limitations....but from what you said earlier, once five years hits with what she did...then she is safe, correct?
Also, she wants to know that if something were to ever come up - would anyone really want to bother with the time and money over these situations?
