Identity Theft by a Spouse During Divorce
During a divorce case, the husband decided to buy a new car. He traded in a jointly titled car, forging the wife's name to the title. He then signed a financing contract and put his wife's name down as a co-borrower, and forged her name to the loan application. By the time the wife found out, it was too late to get the original car back -- the dealership had already sold the car. What are her options?

First and foremost, she should discuss the issue with her divorce lawyer.
Her options include some or all of the following:
1. Filing a police report and seeking the criminal prosecution of her spouse;
2. Notifying the lender that her signature was forged, and that she should be removed from the loan; and/or
3. Seeking compensation through the divorce settlement, if possible requiring that the car be refinanced or that the loan be paid off out of her spouse's share of the marital estate.
