    Promissory Note in Default
    I have a promissary note that is in default by the company
    that has signed the note with me. The company has alot
    of assets including real estate holdings.

    Since they are in default can I just put a lien on this companys
    real estate assests ie record a lien on 2-3 of their propertys
    thru the county recorders. So that I am sercured>?

    I know contractors put mechanic liens on property all the time
    when they do not get paid per a signed contract.

    Cannot I do the same.

    You must get a judgment against whoever borrowed the money from you.

    File a lawsuit against them for the repayment of that money.



    (You are talking about a mechanic's lien in your post...that is not the situation you have.)
