When Can You File for Contempt Over Denial of Visitation
My question involves a child custody case from the State of: Ohio
I have a situation. I'm currently going to court for a shared parenting plan for my daughter. The child is 7 now. Her mother alienated her from me for a whole year. She avoided certified mail and put off the court date for a while. She claims I am violent and that I have not attempted to see my child in over two years, I have consistent photos, text messages and call logs to prove that incorrect. At our pre-trial hearing I was granted an order allowing me to see my child with 7 days notice whenever under her supervision awaiting psych evaluations. The first weekend after court she was kind, she cried and apologized and told me her boyfriend made her do it and he is not nice to my daughter, she even texted me the boyfriend was moving out. The following weekend she was back with the BF and she withheld visitation in contempt of the order on Sunday, and let me see her 20 mins on Monday. This weekend she is pulling the same thing. I commute 2.5 hrs to do these visits. My wife and I are planning to move to the area because it has become evident that the situation is not healthy. What can I do? How will this work in court?
Re: When Can You File for Contempt Over Denial of Visitation
What documentation do you have regarding the denial? And that you provided seven-day notice?
Re: When Can You File for Contempt Over Denial of Visitation
The father has filed contempt stating that ive missed from transporting our son from georgia to florida which the last hearing the judge granted the relocation. I was not able to come to florida because i was unable to travel after going to the doctor and getting written documentation. I comunicated with the father and and he totally cursed me out. He has stated in the contempt that i did not commuicate with him and have missed visits which is all false. What documentation should i file?
