    Can You Get Shoplifting Charges Dropped if You Pay Restitution
    My question involves criminal law for the state of: utah

    I was shopping at the front of the store with a cookware set under my arm. I received a phone call and walked out the front door while on the phone. I had previously made an exchange without a receipt and left my drivers license info so they knew who it was. I realized later when I was home that I had the item but never returned it. The police showed up at my house last night, read me my rights and asked me about it. I was nervous and scared and didn't initially fess up but eventually I told them what happened. I assume that was a bad to talk about it since it was probably taped on their cameras and I didn't have a lawyer present. I have a clean record with no previous offenses. I didn't need the item and want this to go away and feel bad that I didn't take care of it before. I want to go to Kohls to talk to their manager and loss prevention security rep. I thought that if I made restitution to the store I could ask them to have the prosecuter drop the case. Is that a good idea??? Please help. I've never been in a situation like this and I know that my absent mindedness probably won't gain much sympathy. Can the store decide to drop the charges if I apologize and pay for the item?

    Understand it is not a YOU vs. THE STORE action in this case. Society is the one harmed by criminal activity. The state is who is prosecuting you. Once the state has the case, they're under no obligation to listen to the store even if you could convince them with your sob story. You need a lawyer.

    By the way, in addition to the criminal charges, you can expect a letter form Kohls's "lawyers" demanding civil restitution for the damages such activity causes them.
