    Commercial Burglary Charges and Plea Bargains
    Ok, so we are facing 3 counts in California:

    1. Commercial Burglary (459) - misdemeanor
    2. Grand theft - misdemeanor
    3. Possession of stolen property - misdemeanor

    The judge was extremely nice and gave us this to consider:
    1) fines
    2) 2 years probation
    3) 10 days community service

    Every crim defense attorney I have spoken to advises that we should take this guilty plea because the judge is being extremely lenient on these strong charges. In addition, the attorneys advised that taking the case to pre-trial in front of the DA's may cause worse trouble such as the DA's may "up" the consequences.

    My problem is that all these counts of misdemeanors would stay on our background records which would impair our chances of being hired as nurses, correct?

    Should we take the judge's offer and not try to get the charges reduced??? Is it THAT risky to take the case to trial in front of the DA's??

    We really wanted to try to reduce the 3 counts/charges...but what are the risks involved in taking the case to pre-trial in front of the DA's? Some attorneys are advising not to do so and that we should accept the guilty plea and offer.

    SO is this it? The charges are likely not going to be reduced?? We understand how severe the charges are...but what are your inputs on this?? (PaulE? Bam?)

    It sounds like a deal to me, and given that many attorneys have told you so as well, it seems like a safe bet.

    That's just my opinion.

    It doesn't matter if they don't agree...we would just like to hear the different viewpoints on what to take/accept. Thanks!!

    So do you think these convictions will show up on Background Checks as CLASS A MISDEMEANORS??

    If we accept the GUILTY plea, this will stay on our record forever right? This misdemeanor will not clear after a 7-year-period??? Please help!
