    Is Consent a Defense to Statutory Rape
    I'm 19 and live in Missouri, she's 14 and lives in North Carolina. I'm going to see her in north Carolina and taking her with some family to south Carolina by a beach and she was talking to me and wants to have sex is it legal even tho we both live in different states and r going to be in a different state were going on vacation very soon I need to know thanks

    Nope. You would be looking at Federal and State charges. Make it clear before you go it isn't happening. If she keeps pushing, don't go and find someone closer to home.

    Generally speaking, you should also be looking for other adults to date and not minors who could land you in prison.

    The age of consent in SC is 16, and you are too old for the Romeo/Juliet exception. And really, what are you, nuts?

    Stay away from her and find some girls closer to your own age.

    I have the strange feeling we're being trolled, you sicko.

    In fact even though the age of consent is 14 in SC, what you are proposing is still felony sexual misconduct under the law there. It's also a federal felony to take her across state lines for sex. It's illegal in MO and NC, too.

    Actually it IS 14, but there are other laws that make it illegal.

    No lawyer here, but as a potential juror, I say absolutely not. I'll quote a case where there's a guy sitting in jail because he was 19 daing a 17 year old, from i believe your state, where its legal, drove to Florida, they had sex, and hes in prison for 25 because its illegal in Florida.

    IN GENERAL southern states don;t have the Romeo laws, and are very quick ot prosecute this. So No, just don't. Also depending on where your birthdays fall, you are on the VERY Edge of the romeo laws anyway, so l'd strongly suggest you break this realtionship off till she reaches the age of consent(which is probably 16, but you can easily look that up for your self.)

    Again perfectly honest with you, if I was a juror in your case in NC, and there is no Romeo law, I'd be forced to find you guilty of statutory rape. If you fell outside the scope of the Romeo law, I'd be forced to find you guilty of statutory rape as a Juror.

    Are you getting the picture, even though i fully understand this, have had friends try and do this, it is a very bad idea. Even though I feel 14 year olds are fully capable of giving consent, and that their parents should be making sure they understand this risks if they are dating an older guy, I'd still send you to prison till you are 40+ years old if there was no legal loop hole? I seriously need you to understand that, and I am NOT from the south.

    I did my research and everything law wise was soo confusing I'm not trolling this is serious if I was trolling I'd make it more dramatic and dumb I do like to troll tho but when it's time for serious stuff I'm serious so this time I'm serious I just joined this site today and needed some answer from the professionals

    You do need answers from the professionals -- from mental health professionals who can help you understand why you are trying to commit a sex crime with a minor in another state, rather than dating women where you live.

    What matters is the law of the state where the sexual activity would take place. No state has a legal age of consent as low as 14. South Carolina’s age of consent is 16. It does not have any “Romeo and Juliet” exception that would allow for underage sex if the partner is close in age to the minor. North Carolina’s age of consent is also 16. It does have a Romeo and Juliet exception, but only if the partner of the minor is less than 4 years older than the minor. In other words, if you were age 17 the exception would help you. But you are 19, so that exception doesn’t help. Missouri’s age of consent is 17. It does not have a Romeo and Juliet exception. In short, if you have sex with this girl in any of those states you will be committing a criminal offense for which you could end up spending time in prison and may end up having to register as a sex offender with all the restrictions that go along with that. This is a very big deal. I suggest you do not do anything sexual with this girl until she reaches the age of consent if you want to stay out of prison and avoid the trouble and stigma of being a sex offender. There is a huge gap in maturity between age 14 and age 19. Why are you dating such a young person to begin with? That’s troubling in itself. You’d be far better off finding a woman much closer to your own age. Having consentual sex with an 18 or 19 year-old woman won’t risk any legal problems and you’re much less likely to run into unwanted drama that way than dating someone who isn’t even in high school yet.

    If she got down on her hands and knees and begged you for it, and her parents provided written, notarized consent, paid for the hotel room and provided the condoms, you'd STILL go to jail.

    Mom and Dad would go too, but you'd have no defense whatsoever.

    The whole point is that BY STATUTE she is legally incapable of providing consent, and Mom and Dad cannot make the illegal, legal.

    Is that quite clear enough for you?

    Oh. That's why you were asking if it was okay to get her pregnant because she told you her family "is okay" with her being a Mommy at 14/15 ... because you didn't want to have sex with her.

    Yes, obviously you don't want to have a sex. Uh huh.

    If an adult has to ask if it's legal to have sex with a child ... that adult needs help we cannot provide here. And that adult has no business having sex with anyone other than his hands.
