    Forced to Pay Rent to a Roommate
    Hi all,
    First of all I wanted to start of by letting you know I live in California. My girlfriend was living with a Roomate in a condo owned by neither of them. She had been living there for approximately 6 months. Long story short they got into a few arguements and he was locking her out of the place. She had moved out in the early part of June. He has been harrasing her ever since then. He then wanted to charge her 3000.00 USD as he stated she still owed him that much. They had no written contract, lease, etc. She signed nothing and was under the impression everything was paid in full. Again...long story short she needed to get the items out of the place as he would not let her unless she paid him that amount. So she wrote him a check and then removed her stuff from the condo. Turns out the check bounced and he is saying he will be filing criminal charges. Bottom line is that she is broke and she feels she does not owe him the money. Where does the liability fall based on this imformation provided?

    He appears to be in the strongest position in relation to the rent and check - she wrote the check, whatever her reason, which would likely suggest to a court that she considered the obligation to be valid. Also, it is never a good idea to write bad checks.

    Thanks for the reply! She had told me that there was some kind of misunderstanding and that the $3000.00 was for rent she agreed to prepay for the months August through September. The fact that she moved out in June she felt that nullified the agreement. Does that make sense?
