If a custodial parent goes to jail and the child is within the care of grandparents, does the other parent have to keep paying child support to the incarcerated parent?
The parent can seek to modify support, but unless they also seek to modify custody they should anticipate that at best the child support will be ordered payed to the grandparents pending the incarcerated parent's resumption of custody. If payments are being made directly, the payor can seek consent from the incarcerated parent to direct the child support to the grandparents -- the payor would want written confirmation of the incarcerated parent's permission.
