Reporting an Intent to Work When Completing Immigration Form DS-260
Hi,
I am helping my uncle to fill out his DS 260 family based USA immigration visa application form.
In the DS 260 form, one field asks, 'Do you seek to enter the United States for the purpose of performing skilled or unskilled labor but have not yet been certified by the Secretary of Labor?' This question has a Yes/ No answer.
My uncle intend to run a business as a partner that his sister (who is the petitioner for his application) established in USA. So, obviously, he will be performing skilled labor. However, he is not yet certified by the Secretary of Labor because he has not received a visa and has not immigrated to USA yet.
So, what should be the proper answer to this question that will not jeopardize his visa application?

You should keep everything in the same thread. Nobody wants the little pieces of context scattered all over the forum.
I don't know why you insist on poking at your uncle's immigration issue with a stick by asking fragmented question on this and the other forums you've been abusing. Your uncle is likely to end up in immigration hell with your "assistance".
You've not fully indicated what basis your Uncle is enering the US, but you've hinted that it is family based. That would lend me to believe that the proper answer is NO, but given the complete lack of your ability to convey the facts, I would again STRONGLY recommend he get COMPETENT assistance on this application.

What is sad is you are claiming you want to help your uncle but by acting as you are, you are more likely to cause your uncle some serious problems. Immigration matters can be complex and errors unforgivable. By parsing the details of
the entire situation and tossing them out as you believe them applicable doesn't allow anybody to be able to provide you with a complete and accurate response.
For your uncles sake; stop trying to help him before you get his application denied because you screwed things up.

I'm going to again emphasize that you are a danger to your uncle, and to his chances for successful immigration. He should be working with an immigration lawyer, or at least somebody who is not going to steer him in a dangerously incorrect direction.
Your uncle is not petitioning to enter under an employment visa. He's petitioning to enter as a relative of a U.S. citizen. He is seeking entry to be reunited with that citizen relative. If he gets permanent residence, he will gain the right to work incidentally to his being granted permanent residence, but that's not what is present application is about.
A DS-260 cannot be corrected after it is submitted. If you mess it up for your uncle, your mistakes are going to haunt him indefinitely.
