What is the Penalty for Multiple Assault Charges
My question involves criminal law for the state of: Maryland
An acquaintance got into a fight a few weeks ago and ended up with two (2) 1st deg assault, three (3) 2nd deg assault and two (2) reckless endangerment charges. Bail is 75k. Has a prior felony (in PA) for assaulting an officer, prior 2nd deg assault (MD) and prior Aggr Assault (PA). At hearing, they nolle pros'd the two 1st deg assaults. Why would they do that with all those priors? (and when one of the current victims - of which there were 3 - had to go to the hospital?) The only thing I can think of is so the bail could be reduced. Trial on remaining charges is in 3 mos. Do you think there will be any jail time. (disclaimer: I hope so). They are using Public Defender
Re: Multiple Assault Charges W/Priors. How Much Jail Time
If I'd have to guess not knowing which court he'd be appearaing in, but with my experience in Baltimore City, he'd get a sentence suspended down to a year, and he'd spend the better part of that in city jail.
Re: Multiple Assault Charges W/Priors. How Much Jail Time
Update: Indictment last week. The 1st deg assault charge is back, along with the 3 second deg. The individual now has a private atty. (This is for Howard Co.)
