Entering as a Tourist When Your Visa Expires During Your Stay
Hey,
My USA visa Expiration date is 09 OCT 2016
My Departure flight will depart from the USA at 08:25 pm on 09 OCT 2016
& it`s my first time to the USA & i need advice about procedure at both Arrival and Departure ports
& if i`m doing something wrong using such flight ?!!!!
& what if the officer at the port of entry did`t allow me to stay until that date ?!!!
Kindly, Explain!
Re: Date of Departure Problem
Let's clear something up.
A visa does not permit you to stay in the United States. A visa allows you to report to an immigration officer at a port of entry and request admission to the United States; the immigration officer will determine the permitted length of stay based on the documentation you provide. Your permitted length of stay can be for a maximum (normally) of six months, but this is based on on the decision of the officer. S/He will mark the date you are permitted to remain until on your passport and entry stamp.
It is highly unlikely that the officer will not permit you to stay for the duration of your intended stay if you demonstrate that you have an onward ticket, that your purpose of stay is legitimate and that you are genuinely seeking entry under the class of visa you have and that you have sufficient resources to meet the cost of your stay.
There are provisions for, if there is an emergency that delays your departure, obtaining temporary permission to stay until you can depart; you would need to see CBP at the airport of departure. Keep in mind that there are no immigration or customs controls on departure from the United States.

The only problem with using such a flight is that if something goes wrong, and the flight is delayed due to a mechanical problem or weather problem, you might end up overstaying your visa. It would be safer to book your flight one day earlier than that.

Again, the Visa expiration date has nothing to do with overstay. As statedd above the Visa expiration date is the last date you can use it for entry. You duration of stay is determined by what is on your arrival record (I-94). Even if your Visa is good for another year, you have overstayed if you stay past what is on this record. If something happens that you will not be able to leave before the time on the I-94 expires, you can get it extended.
Re: Date of Departure Problem
Thanks a lot for your answers
but i have to explain more ...
When i arrive to the united states and meet the officer,
He will ask me about my purpose of stay and will find out the next,
*My training course is 03-07 OCT
*My flight departure date is 09 OCT 08:25 pm
*My Visa expiration date is 09 OCT ( i know it means nothing but i think it`s like an Alarm for him )
So, i have 3 questions
1- Is there a chance he gives me a stamp to stay for 6 months even my visa expiration date is so close ?!
2- If he gave me a stamp of departure on 09 OCT, so i must leave before 23:59 on 08 OCT or 23:59 on 09 OCT ?!
3- Is it normal or possible that he gives me a stamp to leave on 08 OCT because my course ends on 07 OCT even my flight departure is on 09 OCT ?!
Kindly, answer as soon as possible

You're asking for authorization to stay through Oct. 9, so why would you need a longer authorized stay?

If you are authorized to stay through October 9, it means you must leave on or by October 9.

If you tell him that you are returning home on October 9, and he sees your return ticket for October 9, there would be no reason for him to authorize your stay only through October 8.
Re: Date of Departure Problem
Hope everything goes well
