    Is it Legal for a Tribute Band to Sell DVDs of Their Concert
    I manage a tribute band and we have thought about filming a DVD of one of our concerts. I have seen other tribute bands who DO sell DVDs of their concerts and sell them at their shows. Is this legal and/or what steps need to be taken to sell DVDs legally.

    You need to have the various rights to the songs. Your performances themselves are covered by the performance license collected by the PROs (ASCAP, BMI, SESAC) typically from the venue that you are playing in.
    If you just want to make audio-only recordings (records, CDs, mp3 downloads), you can obtain a compulsory mechanical license just by paying the rights holder (for mainstream stuff, this is almost always the Harry Fox Agency). However, once you get into visual stuff, you're outside the realm of compulsory or prenegotiated agreements. You're going to have to go deal with the publisher who has the rights (typically associated with the group's record company but not always).
