How do I remove the person I cosigned for, off of the vehicle
Background: In May of 2004 I cosigned for my boyfriend (been together for over 4 years he had the same job for over 2 years) to get a truck, less than five days after he got the truck he broke up with me. Since then he has had at least 4 different jobs, and 4 different addresses.

In March of 2006 he didn’t have the money to make the truck payment. He then opted to get a deferment. After waiting two weeks, and a number of calls from the finance company, I called him, he was going to let the payment go late because he didn’t have the $25.00 for the payment deferment charge. I paid it.

From March to October of 2006 the payment has been at least 10 days late (from the due date).

Starting in November of 2006 I had been making the payments on the truck, yet I do not have possession of the truck. I have gone to the dealership and got a key made for the truck, but it does not work to start the truck, it only opens the door.

Currently he is hiding the truck from me. I’ve tried to talk with him on his cell phone (which he just had turned back on after 2 months of it being shut off), and at his place of work, he just hangs up on me.

The finance company is unwilling to help because the only care about getting the money. He knows that I’ll make the payment because I spent years rebuilding my credit.

What can I do to get the truck and/or get his name off the truck?

is your naem on the title in any fashion.

If so is it titled as xxxx "and" zzzzz
    or xxxxx "or" zzzzz

Unless your name is on the title, you actually have no rights to steal the truck and could get yourself arrested for doing so.

You have the right to lve up to your commitment (co-signing) and you have the right to sue the ex-bf for whatever payments you end up acutally making.

On the title and all other paperwork it states "My name" and "His name".

    Nothing new posted????

I have found out that I can get his name removed if he misses paymnets(not upholding his end of the contract).

Anyone know how long this takes, and how many payments he has to miss?

You have found out from what source that you can get his name removed? What will you get his name removed from? The loan? The title?

    The long short version.

Spoke with the loan company, and told them I wasn't going to make anymore payments and to stop calling me (this was just to make them start hounding him or help me). After I said that they said why. I explained I'm not going to pay for a truck I can't drive and that some XXXXX is driving for free. Explained that he was hiding the truck so no truck no payment.

They informed me that if he wasn't making the payments I could go to the courts and have a judge remove him from the loan and title ( on the grounds of him not holding up his end of the contract). Thus, eliminating his part ownership in the truck, and ending his right to drive or hide the truck from me.

I was wondering how many payments he has to miss, and if anyone has done this before, and what are the general out comes are?

Also what type of attonery should I take this to?
