    Medical Bills During Chapter 13
    I have a question that I would like to present, my wife I filed BK 13 almost three years ago. Last year we both were put into the hospital for surgery and emergency room visits. Our medical insurance paid a portion of the bill and we couls not pay the difference due to the inability to pay what they wanted. The total of the bill is 8000.00 plus and we have been served to appear in court on 2/6/07 for the company to obtain a judgement. My question is this can they attach our wages while we are still in Chapter 13 and also to note we do own our house with quite a bit of equity built up. Please help!!!

    They are not affected by the bankruptcy. The bills were incurred after bankruptcy. You've waited with this to the point of being sued, which makes it a lot harder to suggest possible ways to avoid this exact problem. If you wish, you can try to work out a payment plan. Talk to the lawyer who assisted you with your bankruptcy to see what your lawyer suggests.

    So they can garnishee our wages?
