    17-Year-Old Charged for Using a False ID, B&P 25661
    My question involves criminal law for the state of: CA

    I was at a music festival this past weekend. The event was 18+, I am currently 17.
    While handing my fake ID to one of the ID checkers, the send me over to an undercover cop who works at ABC.
    He writes me up a ticket, I get cited for 25661 and it's written as a misdemeanor.

    When he was writing the ticket, the cop told me that it was like a "speeding ticket" and that if I call the court, I might not even have to show up.
    I just want to understand the following:
    1. Is it possible to call the court and not have to show up, and if so, what do I say?
    2. I legitimately didn't have the ID to purchase alcohol, only to get into an 18+ event. Does that lesser the charge/crime any?

    Any help would be greatly appreciated, thank you!

    1. You will have to go to court, especially if you want to mount a defense. Cases are not tried over the phone.
    2. It makes no difference under 25661 B&P. The statute says "or who has in his or her possession any false or fraudulent written, printed, or photostatic evidence of age and identity."

    You do understand that in addition to the fine and the fact you'll be garnering a CRIMINAL RECORD (25661 B&P is a misdemeanor), you're going to lose your driver's license for a year?
    You might want to consult an attorney on this one.

    These are generally handled as infractions and you may be permitted to address it via a courtesy notice if you receive one. Though, as pointed out by flyingron, a conviction "shall" result in a one year license suspension by the court. There may be options for you, but you would have to consult with a local attorney to discover what options might exist for you.
