Staying Longer Than You Declared When Entering as a Tourist
My Canadian friend came down for my wedding on Saturday she told the USA Border that she would buy a ticket on the 29th to go home she never told them when that she can remember.
She forgot to tell them that I invited her down to stay for 1 month or as long as she wants that I would take care of any expenses she has while she is here.
Now I know she can stay here legally in the USA 6 months but does she have to go back sooner cause she forgot to tell them about my invite while they were asking her question's?
Her intention was just to come down for my wedding but now she would like to stay down for 6 months possibly longer.
How can we go about changing this for her while she is staying in the USA?
Re: Staying Longer Than You Declared When Entering as a Tourist
A Canadian who stays in the U.S. for longer than 120 days in a single year is expected to file a form with the IRS to prove that she is a non-resident who does not have to pay U.S. taxes. A Canadian who stays in the U.S. for 183 days or more over a three year period may be required by the IRS to file tax returns.
The agreement between the U.S. and Canada that allows for a possible stay of up to 182 in a calendar year, or 180 days in a rolling year, does not allow for an extension of that period. If somebody wants to enter the U.S. for longer than that period of time, the person should seek an appropriate visa.
If somebody represents upon visiting the U.S. that she will be returning home on a specific date and fails to do so, that person should expect that the USCIS will have records of the original representation and the length of the person's actual stay, and that they are likely to face increased scrutiny upon future applications to enter the U.S.

She was asked 20 Questions by the USA Border she told them that she would buy a ticket on the 29th to return home but she does not remember if she told them when that day would be since her Passport was not stamped doesn't that mean she could stay here up to 6 months ??
And that if she was to want to stay up here longer which her intent was not but it changed while she was here that she could explain that while trying to apply for a green card, visa, or me sponsoring her to live here or such not ??

Before you sponsor her, PLEASE understand what you're getting into. Have you read up on sponsorship obligations?

No I haven't I work full time 10 hour days make good money and paid every week
But you never answered the other question about her passport not being stamped

She doesn't recall what she told the immigration officer, beyond at least implying a return date. We have no way of telling you what the immigration officer typed into the computer.

No she doesn't all she remembers that she would buy a ticket on the 29th the immigration officer then asked her if Greyhound's came back everyday she replied Yes and they let her through.
Now she couldn't of known coming here if the Greyhound's going back to Canada would be sold out for a number of set days even weeks which does happen sometimes which is maybe why they never stamped her passport.
Even if she declared the 29th for instance and lets just say going to the Greyhound and they told us they were sold out until say Sept.16th what she would be able to do about it? Not very much she couldn't of known that ahead of time cause sometimes the website can be wrong.
So now my question is there someway I could contact the border in regards to this without mentioning her name to see if she has to go back or if she is allowed to stay since there's no stamp on the passport ?
You think if she declared a date they would of stamped it or said something to her she had to be back across the border that day but they didn't she is sitting right next to me as I type this so she's letting me know what all was said as I type

And in what capacity do you think you may be able to sponsor her? Spouse? Other? What? Believe it or not, this is an important topic for you.

Is there a reason why she isn't on the phone herself? Seriously.

I'm her friend nothing more and I do not have a house phone that is why my husband and I need to go to work in about 20 mins here.
My Husband and I both work at the same job that it is 10 hour days anything over 8 hours is automatically overtime
Saturdays are double time and a half and holiday's are even more, We are both paid weekly and just myself I make $545.00 Gross income that is after everything comes off per week

She should discuss her situation and goals in detail with an immigration lawyer.
