    Somebody Other Than the Named Petitioner Filed a Petition for a Restraining Order
    My question involves restraining orders in the State of: CA
    My bf's brother's gf filed a RO on me posing as my bf's mother. She stated in this RO against me that the city police witnesses me doing something that never happened. She must have told the judge something like, "I (pretending to be my bf's mom) am in fear for my life etc.". My hearing is monday, what can I do except tell the judge the truth? Her and her bf (my bf's brother) left yesterday, telling my bf that they were going on vacation for 4 days and that they will not be going to court. The court day is monday (today is saturday). I would like to get restraining orders on the two of them because he has a bad temper (mom says he punches holes in walls) and her, I just don't trust her. I have lived there for 12 years and was my bf's mom's caretaker for the first 5 years. His brother and his gf have lived there almost 3 months.
    ** I had my boyfriend go in and video his mother while he asked her about the RO and she knew nothing about it and that was not her signature on it and was upset and said that this is bad. She is 91. I also have copies of her actual signature. The person that did all this works for the juvenile probation dept. and her bf, my bf's brother, also works for the juvenile probation dept. for 25 years. He is a weak man.

    Tell the truth. That's all you do.

    And seriously, don't go filing tit-for-tat restraining orders - that's NOT how you handle situations like this and based on what you've just told us, you have no grounds anyway.

    She is going to get in trouble, right? This is only part of the story. When she had only been there a couple of days, I walked in the back door as I have did for the past 12 years and she was standing at the kitchen sink. She swung around and grabbed a steel gate that they use to keep the dogs away from the back door. She pushed me out the back door with this gate, like a riot police. She started yelling at me, "you are not allowed in here, you and my bf are trespassing and are squatters (his room is a converted 3 car garage and has been for the past 30 years) and if I see you around here again I am going to call the police. After you are gone, then it's my bf, your mom is going in a home and I'm selling the house, and my bf is gonna let me do it because he isn't saying anything about it (he was standing inside the back door looking at her)." My bf's dad and wife was told by her when they (her and my bf's brother) were out to dinner her plans. She also mentioned it to my bf's other brother when he was visiting several months ago. She is a compulsive gambler and even asked my bf's dad to borrow $800 when she just met him (she took him aside and I don't think her bf knew). He said, "no, I'm on social security. I don't have that kind of money." Also about 8 months ago, my bf's brother had a burned up car towed to our house and parked in the driveway for 4 days. He hired the forensic team from our city police to come and gather up evidence. Her son had told my bf that she said that she had left $600 dollars in a purse overnight and that she thinks one of her son's friend had started the fire. BS!! She lossed it at the casino!!

    she didn't have ANY grounds either!

    None of this changes anything.

    You go to court, you tell the truth and then move on.

    Well, either the named petitioner (the mom) is going to show up in court, or she won't. If she does, she will either say that she submitted the document, or she won't. What do you think is going to happen?
