What Conditions Allow for Extension of Child Support After Age 18 in Tennessee
My question involves a child custody case from the State of: TN
My daughter turns 18 this summer, and recently graduated from high school. She is not disabled, but had a large brain tumor 3 years ago that was removed but requires routine medical testing and evaluation. The tests and Doctor/hospital bills are expensive and her father has not offered (and has refused) to pay anything that he's not court ordered to. My fear is once child support ceases, he will cancel her insurance coverage and not assist with medical bills. Can support be considered for extension in a case such as this, given his history, to secure financial assistance?

How long is she expected to continue rigorous follow up?

Why can't she work and get her own health insurance ? If she is not able to work, she can apply for SSI, but she will have to have medical proof that she can't work. Medicaid comes with SSI.

MRI yearly for life. Medical/surgical Care depends on results each year.

You can try to get a new order before she's 18, but based purely on what you've told us so far I don't see you being successful. Mercy makes a very good point, too.

Fortunately, she has no neurological deficits from the tumor. She wouldn't qualify for disability. Plus, she will be a full time college student. Insurance will allow him to keep her on his family plan until she is 26 for no additional cost on premiums, but I'm not sure if he plans to willingly do this.

Most college students work while they go to school. Maybe she can get insurance this way, although it is doubtful if she isn't a full time employee. She can go to a teaching hospital and see if they will do her MRI's.

It's not clear from your post if you realize this. Ignore me if you do and it's just syntax.

Under the Affordable Care Act (aka Obamacare) her student status is irrelevant to his being able to keep her on his policy. His right to keep her on the policy until she is 26 is absolute, regardless of her student status, tax dependent status, or even marital status. He can keep her on his policy if she is a student, if she has a job that would provide her with benefits, whether she is or is not his tax dependent, or even if she is married.

    As can you.

Why do you not add her to your policy?

She works part time- at least 30 hours a week. Insurance not offered. My husband and I do have her on our group insurance policy- her fathers is secondary but it usually picks up the remaining balance after ours has paid. We ( her stepfather and I) can and will cover her medical expenses as long as she's in college- my point is that her father should also feel obliged to help with such an ongoing medical problem that will financially cripple her as a new adult if her parents don't help out.
