Can Your Landlord Require You To Show Proof of Insurance for a Parking Permit
My question involves landlord-tenant law in the State of: Texas I live in apartments and they never had rules about parking first come first serve and now they change it to where you have to get a parking pass that you have to go show proof of tags and insurance I did that and they said that the insurance isn't in my name and it's in my mother-in-law name because my vehicle just got totalled from the flood and there saying my name has to be on the insurance but I called the insurance company and I'm covered because we have different address and the Manger knows I'm borrowing it and I'm disabled so I'm on disability so I'm on a fixed income and can't afford to get a new vehicle right now and so they said even if I'm in the handicap with my handicap tag up it will be towed so I have to park it somewhere else or it will be towed do the have the legal right to do that??

Yep - they can do whatever they want with their land. Since you had no contract stating how parking was to be handled, there is no contract barring the owners from changing their minds or policies or rules. Nothing you can do. Yes, they have the legal right to tow your car and you will be responsible for any fees/costs.

...and they said that the insurance isn't in my name and it's in my mother-in-law name because my vehicle just got totalled from the flood....

If your vehicle was totaled and you have not replaced it, you don't own a vehicle. Are you stating that you borrowed a vehicle from your mother-in-law, and thus that the title and the insurance are both in your mother-in-law's name?

...and there saying my name has to be on the insurance....

Are you telling us that they don't have a problem with your borrowing a car in somebody else's name but want proof that you're an authorized driver under the insurance company? If that is the case, then you should be able to get documentation that you're on the policy from the insurance company.

...but I called the insurance company and I'm covered because we have different address and the Manger knows I'm borrowing it....

And when you asked them for documentation of the coverage so that you could provide it to your landlord, what did they say?

Your name should be on the insurance. Her insurance likely doesn't cover you if you are regularly driving the car under her insurance.

Bottom line here is that you have to get your mother-in-law to have you NAMED on her policy as a driver. The insurance company will issue an endorsement and you can give a copy of that to the management.

If HER car gets towed it's going to cost her $250 to $500 to get it back.
