    Should You Switch to Premium Processing After Receiving a RFE on a Visa Petition
    Hi Everyone

    I submitted my petition for the 0-1 visa through a lawyer using the regular processing and it took about 3 and an half months to get an answer. The USCIS asked for more evidence so my lawyer drafted a response with the new informations and documents i gave him. Now, I asked him to use the premium processing since I know it will allow you to get an answer within 15 calendar days avoiding the long 3 or more months of wait.

    My lawyer told me it wasn't a good idea to do that because in her experience a lot of cases didnt go well for that reason; she stated that the agent in charge to review the response is not the same and if he/she wants to request more evidence because of his/her poor knwoledge of my petition it wouldnt be possible so my petition would get most likely denied.

    Is this true?

    Is it possible that, with the agent's being unsatisfied with the response to the RFE and being unable to meet the premium processing deadline with anything other than a denial, your visa would be denied? Yes, that's possible.
