Mother is Refusing Visitation Until the Father Undergoes a Mental Health Evaluation
My question involves a child custody case from the State of: Illinois. We have been divorced since 2011, custody and everything has been in place with no hitches. I lost my job in Feb and am having a really hard time finding a new one. I am behind on child support and I am depressed from all the financial struggles. My ex picked up the kids and learned from them that my current girlfriend and I got into a argument, they only heard a tid bit of what was said. She then sends me a text message and says she is keeping the kids from me until I am evaluated by a mental health professional. I told her it was none of her business but I was already and I am being treated for depression and anxiety. She states that she will not let me see them until I am evaluated by a proper doctor, not my primary. I sent her and her attorney a certified letter requesting her compliance with visitation. No response. I went to my kids baseball game and she did not show up. She is falsely accusing me of have a mental disability, but I really do think it is because if child support (or lack of). Do I have a case for contempt? Should I file contempt or a motion to enforce visitation? How many requests for compliance should I send before taking legal action? Does she have a case for keeping them from me? My kids are 16 and 14, in my opinion they can make a choice. I feel like I am losing my kids, any advise would be great.
Re: Ex is Withholding Children and Falsely Accusing Me of Have a Mental Disability
They can make a choice when they're 18. File a motion to enforce visitation
