Domestic Violence Charge for Kicking the Front Door
my question is for domestic violence..... i am being charged with domestic violence against my sister when she was not there when all of this stuff went down.. me and my mam and hubby went to my mama old restidents where she used to live with my my sister and her boyfriend to get the rest of my mamas stuff from there.. we ask my sister boyfriend about some stuff and he told us it was none of ur business and then slam the door on my mama hand so i kicked the door and then he called the law on us.. well the whole time when all of this was going on my sister was not there... well the law got called out on us and they charge me with domestic violence towards my sister... my question is how can they do that when she was not there??? her boyfriend was the only one there....

I can't hardly understand you. Even people from Alabama tend to speak better English. However, you do appear to be guilty of third degree domestic violence. You should talk to nobody but an attorney at this point. Kicking at someone's front door fits in to the realm of harassment. If it is someone that meets the list of domestic relationship tests, it's domestic violence.

I suspect that the prosecution is alleging menacing, as a basis of a third degree d.v. charge. ("A person commits the crime of menacing if, by physical action, he intentionally places or attempts to place another person in fear of imminent serious physical injury.") If the sister in fact was not there, then the charge can be amended such that it's no longer a d.v. charge, with the victim being the sister's boyfriend.

There are a whole slew of things listed in the DV3 including both the menacing and harassment. If the poster thought the sister was there, the intent to alarm/instill fear/etc... is enough (even if the sister wasn't there to be so alarmed).
