    How to Move Parole to Another State
    My question involves criminal law for the state of: New York

    Hi, my fiance in incarcerated in Cape Vincent Correctional Facility in New York... He has 11 months left and 1 year and 6 months of parole. Im moving to Kansas in June. How is the process for him to move to Kansas with me and move his parole. Thanks in advance.

    He would need to petition in the court of proper jurisdiction (closer to his parole date) and get permission to transfer his parole to Kansas. Kansas would have to accept the transfer. If not, he won't be moving.

    And to add to this, understand that in general states are not eager to accept supervision of parolees from another state. It costs money for that state, and many states have difficult budget issues. They also don’t see much value in bringing into their state criminals from other states. That might put their own citizens at risk should he commit another offense. So you both ought to be aware that this is certainly not automatic and likely won’t be easy to get Kansas to agree to the transfer.

    He's not married to you. That will make it a non-mandatory transfer. If you decide to marry him in order to expedite it, the fact that it happened while he was in custody will nullify that as a reason. If he doesn't have an established residence in that state prior to his incarceration, that works against his request. It'll be really difficult to get approval.
