Seeking an F4 Visa While Out of Status on a F1 Visa
Hello, i hope you guys could help me answer a few questions...
First i am a f1 student been here for almost 5 years, but my advisor gave me difficult classes and i failed which result in suspension... im in a language school and they r helping me reinstate my i 20 since it is terminated. Im waiting forban answer whether my i20 will be renew or not in Octorber.
Also my family is doing F4 paper and they are claiming me in, the interview is soon to be early next yr 2017... since im out of status right now.. will it be difficult for me to pass the interview with my family and stay in vietnam while my family come here? I dont want to fail.. is there any other ways? Im still legal here because im going to school and waiting for reinstatement of i 20.

    Thanks so much

Understand that F4 preference is the LOWEST priority that there is. You can wait a long time. F4 for Vietnam is currently taking close to THREE YEARS to process.

Note that you probably know this but F-1 is your VISA type. F4 is the family sponsored preference class. It's confusing to some that they use the same letters for both designations.

You're out of status NOW. Unless the school reinstates you (or you find another) and get a new F-1 status, you are in trouble. I'm not sure what a "language school" is but five years is a long time for any program. You should get yourself

I transfered to this language school just 5 months ago. And they just sent out my reinstate paperwork for i 20. My question is after the paper come back and they do not approve my i20 reinstatement, i have to go back to vietnam, then when f4 comes and its turn for my family to interview, am i going to fail because i failed school in the U.S?
    Thanks again

Ending your study (either because you voluntarily withdrew or you were terminated for academic reasons) should not affect further immigration actions, provided you timely leave (they like you gone within 30 days) rather than accuring a lot of illegal presence.

    O

Okay thanks, so you are saying if my paper for reinstatement come back and they say i have a new i 20, i could stay and continue my education career then when my fam f4 interview comes i could just interview with them fine right?
And if the goverment said no to my reinstate i 20, then i can just go back to vietnam and wait for f4 interview. Either way should not affect my interview pass or fail right? I just have to be honest?
