    Minor Speeding in Excess of 100 MPH, Caught With Alcohol
    My question involves criminal law for the state of: CALIFORNIA

    Hi, i'm a caucasian male, 17, almost 18.
    I got charged with 100+MPH (PACE)
    The cops had my friends pulled over around 10-11PM, as I passed by them while they were getting ticketed for possession of lighters underage, I lightly honked at them as I passed by and drove for around 30 seconds before my friend calling me and telling me that they dropped their tickets and are coming after me, I hopped on the freeway crusing steadily at 80mph, as I look half a mile away I see 3-5 cop cars bolting torwards me pulling me over shortly and checking my eyes to see if I am under the influence(which I was not at all), they tell me that I was going 120 MPH apparently because they had to travel 120MPH to reach me, LOL. If you are half a mile behind me, how could you possibly pace me? (CLEAR FREEWAY - FREEWAY HAD CURVATURE 11PM)
    I am looking to file a Trial By Declaration, asking officer for discovery. If all else fails, I had 3 people in my car and 4 people that were pulled over to be witnesses in the actual trial if that will help.

    I also got charged with Poss of Alch
    The bottle of alcohol which was not mine, was never told to me that it was being placed in my trunk by my friend, I never knew it was in the trunk so I allowed the officers to search the vehicle finding the bottle in a box in the trunk. My friend told them it was his but they proceeded to give me the ticket.

    (Arraignment is schedules at juvenile probation office, I am looking forward to pleading not guilty. Also my friend will be telling them that he put the bottle in my trunk without my notice)

    Purchase of Alcohol
    About a week/two weeks later I went to my family friends liquor store to grab a beer for my mothers stew recipe, this was around 10-12 PM, My family friend had already put the beer in my trunk and I was leaving the store and headed to my trunk to check it, when a undercover Alcoholic Beverage Control agent approached me and asked me what I placed in my car. I said nothing and so he cuffed me without reason and took my keys, opening my trunk and grabbing the beer which was just sitting in the trunk.
    (I am not sure what to do with this ticket, the car is under my fathers name.)

    Please give me advice on how I can fight these tickets. Thank you.

    I made this more clear, the other thread didn't help much at all as I was getting bombarded by people not helping me but doing the opposite. Let's start off fresh and get me through with some assistance please.

    Also - At the moment when the officers found the alcohol in the trunk this is what exactly went down.
    Officer - Who's is this?
    Me- I don't know it's not mine
    Officer - Okay well you're going to get a ticket for it
    Me - What if it's my fathers or something(Since car is registered to my dad)
    Officer- Okay that's fine tell the judge that.
    Me- Whispers to friend, are you going to take the blame?
    Friend- Yes officer it's mine
    Officer - Laughs and asks how did it get there
    Friend - Well we were leaving the party and I went to open the trunk and put it in
    Me- He didn't tell me that he was putting that in there
    My friend agrees to take the blame for it in court since it is ACTUALLY HIS.

    I walk out of the store beer hidden in jacket, open my trunk, toss it in look to my left and see an ABC officer walking up to me, It was not visible at all that I put something in my trunk, I closed the trunk he comes up
    Agent- What did you throw in your trunk?
    Me-Nothing
    Agent-Handcuffs me (I comply)
    Me-What are you doing? Etc
    Agent- Takes keys and grabs beer out of trunk
    Agent- Proceeds to write me a ticket for Purch of Alch
    Me- I was transporting it, etc
    Agent- Well you need a written letter that you are allowed to transport it
    Me- Sorry I didn't know that
    Mother- Comes to pick me up, we explain to them that it was for stew
    Agents- Explain it in court
    (I filled out a form for them, they said it would ease my case if I filled it out)
    (They never saw me purchase or the beer visible in my hand.)

    Nothing has changed from your other thread. You are guilty. We are here to discuss the law and it's application, not necessarily to help people get out of righteous tickets.

    You can't fight it.

    You won't be laughing when the courts and your insurance company get through with you.

    Were I your parent I wouldn't lift a finger to help you.

    Really? I can't fight it? Even though you've been on the forums for 3 years and have 10k posts doesn't mean you have to lie and be a jackass.

    Update: My friend went in today for his court date and the judge gave two options, One was court and the other was a fine of $250, community service and a license suspension of 1 year.

    OK, I was wrong when I wrote that you can't fight it.

    Of course you can "fight it" if you mean going to court, pleading not guilty, and raising a defense to the charges.

    If, however, you mean avoiding conviction for the violations, no, that's not likely going to happen.

    You are free to fight whatever you want. Perhaps you'll be fortunate enough to stumble across somebody who is willing to believe your story.

    When he went to court your friend was given the opportunity to plea bargain? That's a real shocker.

    What specific statutes have you been charged with violating?

    I don't see any real good defense, here. But, dumb luck might work. If the officer fails to show up, you can win. if he does, things become far less likely.
