    How Could Somebody Find Out About Your Criminal Record
    My question involves civil rights in the State of: Florida

    My girlfriends ex husband has found out my criminal history and is threating to take her kids away..He has my social security number , DL number, all my previous addresses and so on..He didn't know my name..My car has been parked at her house when I'm with her..Only way he could have gotten my info was to copy my plate and have a law enforcement buddy run my tag..What recourse do I have for that?..I know that's illegal but do they have a way to find out who did it?..Or is she wasting her time filing a complaint?..Any good help is appreciated..

    She can't file a complaint. You can file a complaint.

    What she needs to worry about is whether your criminal history is enough to cause her to lose custody. THAT is by far the bigger issue.

    I doubt that your local law enforcement agency will do anything about this, if this is actually what happened. Most law enforcement agencies don't have the time or resources to spend on something like this. If your criminal history indicates that you have been and may be a danger to children and you don't want her to have to go through a court battle, you should break up with her. Her losing the children is something that only a Judge can decide. If your criminal history involved children, it concerns me that she is even seeing you.

    You are assuming something that is not true. There are all kinds of ways the he might have found that information. Since it is your information that he obtained, it is up to you to make a complaint with the police about this if you wish. But unless you have been harmed in some way by it the chances are the police will not do a whole lot about it. Note that your criminal record is a public record unless it was sealed and there are many sources for getting that information. So if that is the only thing here is causing you trouble, then the police won’t be able to do much about that.

    I know it's illegal for Leo to run your tag without probable cause..He had no way of knowing who I was..License plate data bases are only available to Leo..I just don't like the fact he's holding that over her head..But I will file a complaint with internal affairs just for a written record..

    Deary, it's not difficult to identify idiots online. It's also not difficult to use Google.

    You should remember that, deary. I imagine the court would be very happy to ensure the wellbeing of these poor children, even if that means Mommy no longer has custody. Perhaps she should remember that. If she won't put their welfare first, the courts will. :cool:

    Maybe he found out from the landlord, or one of her buddies, who you are. You have no proof it was a cop. Once you have a name, you can get a basic background check for about 35 bucks. More info can be had for free, all by search engine. It's all legal, too.

    Even if you live in a large city, they can be like small towns. Unless you are hiding out, which you obviously are not, there are countless ways that someone can get the info. Court records like this are public. All I needed many years ago was a persons name and I could find out if they had a criminal record and for what along with other info. Also if they had ever been in court for civil matters. Maybe the children said your name or your girlfriend let it slip. Maybe a neighbor has a friend or relative that works with you. Even if your criminal record is from another town and/or state, that is not hard to find now days.

    You have no proof that anyone in law enforcement obtained this information. And if they were to look into it and find that an officer did get it, you would not know about it.

    Actually, in most places it is not at all illegal for the cop to run the plate. The license plate number is in plain public view, so the Constitution does not demand a warrant before running the plate nor require probable cause before running it. You did not say in what state you are located, but in most states there is no requirement that an officer have probable cause or even reasonable suspicion to run a plate, either. Disclosure of the information the officer obtained to persons outside his agency or for any unofficial purpose might violate state law or department policy, however.

    Even if what was done was a crime, the problem is that I’m guessing you have no proof whatsoever that any law enforcement officer did what you allege he or she did. As I said earlier, there are lots of ways someone can get your criminal record. That record is public information, so sharing that isn't a violation of the law unless the record was sealed.
