    Is the Good Samaritan Law a Defense to Public Intoxication
    My question involves criminal law for the state of: Pennsylvania

    So a few days ago, I went out to the bar with my roommates to have a few drinks (I'm 22 years old so I'm of legal drinking age). I left alone relatively early (around 11:30 o'clock) because I had to be up early the next morning. Upon leaving, I was completely in control of myself and not belligerently drunk. I was walking home on the sidewalk and stopped to talk to a friend for a few minutes that I noticed in a parking lot right off the sidewalk. Back on track walking home I hopped down from about a 4/5 foot wall down to the sidewalk that I've traversed many times before, but this time my footing failed me and I ended up landing awkwardly and hurting my knee as well as smashing my face on the ground. (I ended up losing a few teeth and getting a concussion) I was knocked out for a few minutes and upon coming to a girl that I know and her friend helped me up and checked to see if I was okay. They then tried to help me walk home but couldn't do it since i kept passing out from pain and the head trauma so i was basically dead weight and too heavy to carry home. I told them I needed to go to the hospital so they called 911. A few minutes later a police officer showed up and asked about the whole situation and proceeded to put me in the back of the car and take me to the hospital. I ended up getting cited with a public intoxication on top of it all. My question is, under the Pa Good Samaritan law would i not be protected from citation since the only reason that the police were alerted of the situation was due to a call for medical attention? Is there any way I can get out of this or at least pay the minimum fine? I appreciate any help I can get, I just don't want to go to the courthouse and get hit with the highest fine possible since it was really just an unfortunate situation.

    How do you see the pa Good Samaritan law applying here? The good Sam law protects people who come to the aid of others. I simply can't see how you are trying to stretch it to protect you from a criminal issue.

    Wasn't trying to stretch it, I've heard people say it covers both parties but clearly that's wrong after reading your response. I posed the question because i didn't know the extent of the law. Thanks for the feedback.

    The Pennsylvania Good Samaritan law absolves those who come to the aid in good faith from CIVIL action.

    Thanks for the feedback, it looks like i was misinformed but i figured it would only cover those who came to aid, figured i would ask anyway. Any other advice?

    Call a lawyer. The way you described the events here, makes it sound like you were too drunk to even walk home, and you were still publicly intoxicated regardless. Lesson learned.
