How to Report Theft and EBT Card Fraud
My question involves police conduct in the State of: FL

As discussed in other posts, about a month ago I was arrested for alleged domestic battery.

Within less than a few hours of my arrest, my ex girlfriend can be seen on my security camera footage , loading up lots of boxes and bags of stuff in my van, and then going away somewhere with it all. She later brought the van back to my home, and then abandoned the property with my son.

Due to the arrest and charges, there was a no contact order placed on me not to contact her. There is an exception in the NCO for contact with my son through a 3rd party, but she has otherwise not made my son available for me to visit, and my current family law attorney may be soon having difficult getting her served due to lack of address.

Since she has left, I've noticed items that belong to me have gone missing. In particular, a camcorder and memory card that had lots of recent pictures and video of me, my son, and her (family) on it. I also learned she used an EBT card that was in my name. Unfortunately, she did have the PIN number, but since she's left the household she really doesn't have permission to use it, and I could not have even given her permission to use it after this, since the money was not on the card until long after I was arrested and bonded out for pre-trial release. I've since reported the card lost/stolen. Also, she hasn't yet given any notice to me or anyone else that she intends to be officially "out" of this household , along with my son, and clothing and other things of hers are still here, along with my boy's toys and other things.

I call the dispatch for the police in the jurisdiction of her last known location, but didn't follow up, because I was worried about making my situation worse by upsetting her or alerting her to anything. Later, my family law attorney also suggested that I do not call the police until/if she was served the papers, of which we don't know if we'll be successful on serving at this time.

So, my question is, if she is found for the court papers, will the police help with this, or will I inevitably get the "it's civil" runaround? My main concerns are the return of my camera and memory card, the use of the EBT card and loss of that money, and any welfare check that the police could or would do for the safety of my son. I know the police love to use the "it's civil" thing, especially when two have shared the same house, and it happens to be the man making the complaint. However, when the neighbors called about us fighting, it certainly wasn't considered "civil" then. I do have proof of purchase of my camera, although I bought it about 2 years ago. I may soon have printable evidence of the use of the EBT card in a location near where she may be.

Thanks for any ideas/help on this!

To report the EBT fraud, but they might want to know why you gave her your PIN. Report the camcorder stolen.

Tell your lawyer where she used the EBT card, it might help the PI (when/if you hire one) to locate her.

Thanks. I'll look into that, but I did talk to the agent when reported lost/stolen. Basically, she explained it as they don't much care because it's a PIN card. Anyone using it is assumed to have the PIN. She did however say that it could be taken up with law enforcement, but wasn't clear how.

She had the PIN of course, because prior to all this, we were together, and she did most of the grocery shopping. She hasn't yet appeared to file for any welfare on her own, despite not having any money and trying to use my EBT card. She's still listed in this household with state. Sooner or later, I will have to report her and my son as out, but I'm not sure how that works entirely, and again I literally don't know her plans nor for sure her whereabouts or my son's for that matter. I'm assuming if she applied for any state benefits, she'd have to provide a new address, and I don't think she's done that yet, nor changed her address with USPS.

I was already told where she used the card, which confirmed the suspected location. The problem is, we don't know how long she planned on staying there, or if she's still there. It took several days to get the petition filed, and the process servers working.
